Making A Purchase

TERMS AND CONDITIONS

1.In these terms and conditions except where the context otherwise requires the following expressions shall have the stated meanings:

" Company" means Ron Daley's Ltd T/A Scooter Crazy

"Customer" means the company, person or firm dealing with the company.

"Goods" means the vehicle, extras and/or accessories to be supplied by the Company to the Customer.

2. This Contract and any allowance in respect of a part exchange offered by the Customer are subject to acceptance and confirmation by the Company.

3. The Company will endeavour to have the Goods available by the estimated delivery date but does not guarantee the time for delivery and shall not be liable for any damages, losses or claims of any kind to the Customer in respect of any delay.

4. If the Customer shall fail to take delivery and pay for the goods within 7 days of notification that the Goods are available for delivery, the Company shall be entitled to treat the Contract as repudiated by the Customer and thereupon any deposit paid by the Customer shall be forfeited without prejudice to the Company's right to recover from the Customer by way of damages any loss or expense which the Company may suffer or incur by reason of the Customer's default.

5.Ownership of the Goods shall remain with the Company until the full price thereof has been received (including any payment or part payment from a Finance Company) and cleared by the Company. Risk in the Goods shall pass to the customer upon delivery of the Goods by the Company to the Customer. Notwithstanding that property in the Goods has not passed to the Customer, the Company shall be entitled to sue for the price of the Goods.

6. The Company shall agree to accept a part exchange for the price of the Goods subject to the following conditions:

a) That the used vehicle is either the absolute property of the Customer and is free from all encumbrances or is the subject of a hire purchase agreement or lease agreement capable of a cash settlement by the Company, in which case the part exchange shall be reduced by the amount required to be paid by the Company in settlement thereof.
b) That if the Company has examined the used vehicle, it shall be delivered up by the Customer in the same condition, as at the date of examination

c) That the used vehicle shall be delivered up to the Company on or before delivery of the Goods to the Customer and the title in the used vehicle shall pass to the Company absolutely upon such delivery.

d) That if the Goods through no fault of the Company shall not be delivered to the Customer within 30 days after the date of this Contract or the estimated delivery date (where that is later), the amount of the part exchange allowance shall be subject to reduction by an amount not exceeding 2.5% for each complete period of thirty days from the date of the expiry of the first mentioned 30 days. To the date of delivery to the customer.

e) That the statements and representations made by the Customer in relation to the used vehicle are true, accurate and correct.

7. In the event of breach by the Customer of any of the conditions in clause 6:
The Company shall be discharged from any obligation to accept the used vehicle.
If the Company accepts the used vehicle, the Customer shall be liable to the Company in respect of any loss or damage suffered by the Company as a result of the breach of conditions.

8. If the Goods to be supplied by the Company to the Customer are brand new, the following provisions shall have effect:

a) The Contract between the Company and the Customer shall be subject to any terms and conditions which the Manufacturer of the Goods may from time to time attach to the supply of the Goods or the re-sale of the Goods by the Company and the Company shall not be liable for any failure to deliver the Goods occasioned by its inability to obtain from the Manufacturer or Concessionaire.

b) The Company undertake that it will ensure that pre- delivery work specified by the Manufacturer is performed and that it will endeavour to obtain for the Customer the benefit of any warranty from the Manufacturer or Concessionaire

c) Notwithstanding the amount for Value Added Tax specified in the Contract, the sum payable by the Customer in respect thereof shall be such sum as the Company is legally liable to charge at the date that the taxable supply occurs.

d) If after the date of this Contract and before delivery of the Goods to the Customer the Manufacturer or Concessionaire's recommended price for any of the Goods shall be increased, the Company shall give notice to the Customer of the amount of the increase which the Company intends to pass on to the Customer. The Customer shall have the right to cancel the Contract by written notice to the Company within 7 days of the receipt of the notice from the Company. If the Company does not receive such notice, the increase in price will be added to and become part of the contract.

e) In the event of the Manufacturer of the Goods ceasing to make goods of that type, the Company may by notice in writing to the Customer, cancel the Contract and the Company shall be under no further liability whatsoever to the Customer other than to return any deposit paid by the Customer

9. The Company will not accept responsibility for any loss arising out of the negligent use of the goods in respect to the end user or to third parties

10. Our terms and conditions may change from time to time in accordance with the relevant or applicable law. We reserve the right to change our terms and conditions without notice.

Shipping And Handling

All accessory / clothing / helmet orders over £75 qualify for free Mainland UK shipping. As we use couriers for most shipments, free shipping does not apply for the Scottish Highlands and Islands,Channel Islands, Isle of Man and Northern Ireland. For these areas you will be contacted with a shipping quote prior to your order being processed.

Mainland UK orders under £75 are subject to £5.95 shipping charge. All UK orders are sent via courier service or Royal Mail.
We aim to despatch all goods within 5-7 working days unsless stated otherwise in the delivery tab within the item. In some cases an item may be out of stock with a supplier. Any delays or inability to supply through end of line/company back order will be notified by email

International Shipments. If you are outside the UK an appropriate shipping charge will be calculated which is dependant upon weight, size and country. Before taking any payment we will email you the charge and await your acceptance.

Delivery Schedule

We aim to dispatch all goods within 5-7 business days unless the item description states otherwise. If an item is out of stock with a supplier you will be notified by email.

International Shipments - If your order includes a 'special order' item. Please be aware that these have to be ordered in direct from European suppliers. The shipping schedule is estimated at 7-12 working days. Please take into consideration that this could be subject to delay. Please also be aware that items may take slightly longer in production and unfortunaley we cannot forsee this and additonally have no control over this.

Customs- Please be aware that some parts/accessories are ordered in internationally. This means the parcels can be subject to 'customs clearence' before being delivered to us. We have no control over this and it is done completely at random. We also have no control over the time in which it takes for the release of the parcels. We appriciate your understanding and patience with this. And be asured we do all we can to speed this process up.

***CANCELLATION ON SPECIAL ORDERED ITEMS***

UK- Please read delivery times carefully. Once items are ordered from Europe we cannot canel the order. If you choose to cancel your order after we have placed the item on order from Italy. Your order will be subject to a cancellation fee of 10%. This will be deducted from the final refund.
International- Once shipping charges are confirmed and items are ordered and processed. Any cancellation requests will be subject to a 10% cancellation fee. This will be dedcuted from your refund.

Back Orders

If your item is not in stock, we will back order for you and dispatch as soon as it arrives, you will be notified of the delay via email.

Tax Charges

20% VAT is charged on all new orders. Helmets are exempt from VAT

Credit Card Security

All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site, your credit card details are very safe at all times.

Guarantee

All motorcycles and scooters come with a manufacturers warranty :
Piaggio/Vespa/Gilera all come with a 24 months parts and labour warranty.
Derbi and Aprilia Motorcycles come with a 24 months unlimited mileage warranty.
No manufacturer warranty is applicable to off road bikes and quads.

Clothing, helmet and accessory warranty periods vary with each manufacture. We are more than happy to provide this information prior to purchasing.

Privacy Policy

Ron Daley Motorcycles Ltd T/A Scooter Crazy respects the privacy of it's users. This privacy statement explains how we collect, use, disclose and safeguard your information when you visit our website www.scootercrazy.co.uk including any other media form, media channel, mobile website or mobile application related to. We recommend you read the policy in full.

What information do we collect.

To process your order we require your full name, address, telelphone number and email address. These details are used to ship goods to you once ordered and to make contact should any issues arise.
Order details are kept for 7 years for both accountancy and warranty purposes.
Your payment details are processed through third party companies Sage Pay and PayPal. Please visit their websites for details of their privacy policies.

If you are applying for finance, additional details are required including full name, address, date of birth, previous address details, bank details, occupation, nationaility, marital status, income and number of dependants. These are used for the actual finance application which is processed through third parties including but not exclusive to Black Horse Finance and Pegausus Finance. Third party privacy policies can be found on their own website.

Security

All information is kept on secure, password protected programmes. Any paper form information is stored in the company safe. We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

Returns Policy

Scooter Crazy offer a 7 day returns policy on all parts and accessories. Goods may be returned if unused and in the original saleable condition. Shipping is charged at £5.95 for orders under £75, items returned for a refund will not have this included in the refund.

Please send us an email stating the reason for return. Please note that to qualify for a refund, goods must be returned in un-used and original condition/packaging. A refund will take up to 14 days to complete. The amount refunded will be the full amount of the order, less the cost of delivery. Customers will have to pay any returns postage charges. Due to safety reasons helmets will be subject to a full inspection upon return, any damage / scratches will deem the helmet unsaleable and the return will be refused. Any goods returned for exchange will be subject to a shipping charge for us sending the new size/colour etc.

International customers. All returns, regardless of reason, MUST be marked as a return for customs purposes. We are unable to make payment of any customs charged for returned goods.
